What is the difference between legal separation and divorce in Utah?

Legal separation allows spouses to live apart and divide finances without formally ending the marriage. It can be useful for religious reasons, insurance purposes, or when couples are unsure about divorce. A legal separation can later be converted to a divorce. Utah courts handle both proceedings similarly, but the marriage remains legally intact in a separation.

How long does a family law case typically take?

It depends on the issues involved. An uncontested divorce with agreed terms can be finalized in as little as 91 days (the mandatory waiting period plus processing time). Contested cases involving custody disputes or complex property division can take 12–18 months or longer if they go to trial.

What if my spouse and I agree on everything?

That's ideal. An uncontested divorce is faster, cheaper, and less stressful. I can draft a comprehensive settlement agreement covering property, debt, custody, and support — and walk both of you through the process. Even when you agree, having an attorney review the documents protects you from oversights that could cause problems later.

Can I modify a family court order after it's entered?

Yes, in many cases. Utah courts can modify custody, support, and other orders when there has been a 'substantial change in circumstances' — such as a job loss, relocation, or a significant change in the child's needs. I help clients pursue modifications when life has genuinely changed.

What happens to the family home in a divorce?

Options include one spouse buying out the other's share, selling the home and dividing proceeds, or continuing joint ownership temporarily (sometimes until children finish school). The right answer depends on finances, equity, and what both parties can afford post-divorce.

Do I need a lawyer if my divorce is amicable?

It's still strongly advisable. Even friendly divorces can overlook important issues — retirement account division, tax implications, insurance coverage. A poorly drafted agreement can cause serious problems years later. My role in an amicable case is to make sure the agreement is complete, fair, and legally enforceable.
